Competition in domain shoreline lies primarily with the General State Administration, namely the Government of Spain under Article 149 EC. 
Easements of the Coastal Act are limitations on ownership of lands adjacent to the seashore to protect the maritime public domain land and have the character of limitations. 
To determine the maritime-terrestrial public domain shall be undertaken and approved by the State Administration of appropriate boundaries. In the proceedings will be heard the Autonomous Region and the Municipality concerned, the adjoining owners, upon notification, and others attesting to the status of stakeholders. 
The entry into force of the Comprehensive Plan of Marbella has led to a dual legal security. First, the investor seeks to buy land that already has the legal security of the urban planning of it and, secondly, the owner of a home whose license may have been challenged as being contrary to General Plan 1986, by the fact that the 2010 General Plan recognizes the building. 
The ordinance is keeping the legal system more favorable to landowners affected by the standardization in the Plan of Marbella.
